Event Objectives:

This video seminar/workshop is designed to provide and extensive overview of what Best Interests of a Child are and how to present them in Humanitarian and Compassionate Cases.

I. Learning Expectations/Goals

1. The learners will understand the steps and key concepts when assisting clients with the applications for PR based on BIOC inland and overseas in H and C cases.

2. The learners will understand the key terminology and how it is applied to a variety of the applications for H and C with BIOC as the main objective for PR.


II. Terminology and the key concepts

• Foreign national

• H and C applications and grounds

• the level of dependency between the child and the H&C applicant

• the degree of the child’s establishment in Canada

• the conditions of that country and the potential impact on the child

• medical issues or special needs the child may have

• the impact to the child’s education

• matters related to the child’s gender.

I. Learning Expectations/Goals

Assessing Eligibility

1. BIOC and H and C specifics, Proof of BIOC.

2. General: Inadmissibility, Inland/outland, dependents, status in Canada, Financial/funds, medical exam and biometrics, length of validity of the passport, age, etc.


Application Process and related laws

1. How to assess the applicant: the complete approach to H and C cases.

2. UN Human Rights Convention on the Rights of the Child and Right of Children recognized in Canada https://www.canada.ca/en/canadian-heritage/services/rights-children.html

3. H and C overview and A25(1).

4. The Application Process and the Deadlines. H and C process and what is the background of the sample situations/cases.

5. The relationship between the child and the sponsor/applicant.

6. The key elements of each application and how to present the application (including the submission letter and the proofs) to gain the approval.

7. The Situation When the Children Are 18 Years or Over

This seminar is designed for licensed paralegals and Immigration Consultants; some lawyers will also be in attendance.
