Event Objectives:

This course examines family sponsorship under Family Class program for the purpose of family reunification and provides step-by step guidance to a sponsored person’s pathway towards permanent residence in Canada. In that sense it is crucial to understand the distinction between family class (as a broader immigration category that encompasses all family relationships to eligible sponsor), and a family member (spouse, common-law partner, conjugal partner, and dependent children). In the spotlight will be also the difference between traditional definition of marriage (as union of two people of opposite sex), and modern definition of marriage (gender neutral definition, which includes same-sex marriage and common law partners); legalization of same-sex marriage in Canada (as the fourth country in the world - after the Netherlands, Belgium and Spain, and first country in North America, which legally recognized same-sex marriage in the year of 2005). Genuine (bona fide) marriage versus bad faith marriage/marriage of convenience entered into primary to gain the benefits under the IRPA will be discussed as well as divorce of convenience; excluded relationship; who is eligible to be sponsored under the family class; eligibility evaluation of sponsor and sponsored person; sponsorship agreements between the sponsor and the government; the length of undertaking as unconditional promise that cannot be cancelled after the sponsored person landed in Canada. The focus will be too on repeal of conditional permanent residence as a pretext for new measures that Canada introduced in order to protect vulnerable people who are victims of family violence; 5-year bar for sponsored person to sponsor someone else; overseas versus inland sponsorships; requirements for sponsorship applications for parents and grandparents, including income for the 3 taxation years before applying. Also covered are applications based on Humanitarian and Compassionate (H&C) consideration, an overview of different court decisions (case laws) pertaining to the Family Class immigration (such as Baker Case and its factors when the best interest of the child is in the matter). While the most common family sponsorships are revolving around spouses, common-law partners, conjugal partners, dependent children, or parents and grandparents, as a part of the family class sponsorship program, there is also provision for “other relatives” who could be sponsored under specific conditions. It also allows Canadian citizens and permanent residents to sponsor certain extended family members (such as orphaned siblings, nieces, nephews, aunts, uncles, and de facto family members), although this option is more restrictive and has more limitations in comparison to the sponsorships of immediate family members, so those restrictions and limitations will be explored as well.
